Terms & Conditions

These Terms & Conditions apply to bespoke cakes, desserts, wedding commissions, corporate orders, dessert tables and event services supplied by Bombshell Bakes Ltd. We want the process of creating something beautiful to be enjoyable and straightforward. These terms explain how bookings, payments, changes, deliveries and other arrangements work. Please read them alongside your quotation, invoice and booking confirmation.

1. Enquiries and bookings

An initial enquiry is an opportunity to discuss your requirements, ideas, event date, budget and the practicalities of your commission. It does not reserve a date or constitute a confirmed booking. A booking is confirmed once: - - We have agreed the quotation and essential requirements.
- You have accepted these Terms & Conditions.

- We have received the required booking payment.

As a small, independent atelier, our production capacity is limited. We reserve the right to decline enquiries where we cannot reliably fulfil the requirements.

2. Quotations and pricing

Each bespoke commission is quoted individually, taking into account design, size, ingredients, complexity, preparation, production and any agreed delivery or setup requirements. Your quotation will identify the agreed products or services and any additional charges. Changes to the agreed requirements may affect the price. Any additional charges will be discussed and agreed before the relevant work proceeds. Quotations remain subject to availability until a booking is confirmed.

3. Booking payments and balances

For commissions booked more than one calendar month before the event, a 50% booking payment is required to confirm the booking. The remaining 50% balance is due one calendar month before the event. For commissions booked within one calendar month of the event, full payment is required upon confirmation. Payment deadlines and bank transfer details will be provided on your invoice. Alternative payment arrangements may occasionally be agreed in advance. The initial payment contributes towards reserving production capacity, planning, design development, administration and preparations for your commission. It is not automatically forfeited in full if a booking is cancelled. Any cancellation deductions will be assessed in accordance with Section 5 and applicable consumer law.

4. Late or outstanding payments

Payment must be received by the deadline shown on your invoice. If a payment is overdue, we will contact you to discuss the outstanding balance. Where payment remains outstanding, we may suspend further preparation or, where reasonable and lawful, cancel the commission after providing appropriate notice. Any resulting cancellation charges will be assessed fairly, taking account of work undertaken, costs incurred and any losses reasonably arising from the cancellation.

5. Cancellations by the customer

If you need to cancel your commission, please notify us in writing as soon as possible. Bespoke commissions involve reserved production time, creative work and, in some cases, specially purchased materials. Any amount retained following cancellation will reflect reasonable costs and losses arising from the cancellation, including work already undertaken and commitments that cannot reasonably be recovered. We will take account of costs avoided, any materials that can be reused and opportunities to mitigate our losses. Depending on the circumstances, a partial or full refund may be appropriate. Equally, where substantial work or preparation has already taken place, reasonable cancellation charges may apply. We will explain the calculation of any amount retained or outstanding. For bespoke or perishable goods, the usual 14-day change-of-mind cancellation right may not apply. This does not affect your statutory rights where goods or services are faulty, misdescribed or not supplied with reasonable care and skill.

6. Postponements and changes of date

If your event is postponed, please contact us as soon as possible. We will consider requests to transfer a commission to a new date, subject to availability, production commitments and the nature of the order. A revised date may require a new quotation where costs, scope or requirements have changed. If we cannot accommodate the proposed new date, the original booking may need to be treated as a cancellation, with any charges assessed under Section 5.

7. Design and creative interpretation

Every Bombshell creation begins with a conversation. We welcome inspiration photographs, Pinterest boards, colour palettes, themes, references and descriptions of the overall feeling you would like to achieve. These help us understand your vision, but we create our own artistic interpretation rather than exact reproductions of another maker's work. Formal design sketches are not routinely supplied. Where a sketch or visual plan is appropriate, this will be discussed as part of the commission. Our work is handmade, and small variations in colour, finish, placement and decoration are natural characteristics of bespoke edible art. We will aim to deliver the agreed creative direction while retaining reasonable artistic discretion over the finished design.

8. Design changes after confirmation

Please request changes as early as possible. Whether a change can be accommodated depends on the stage of design or production, materials already purchased, available time and the practical requirements of the commission. Significant changes may require a revised quotation or additional payment. No chargeable change will be made without prior agreement. Where a requested change cannot reasonably be accommodated, the original agreed commission will remain in place unless an alternative is agreed.

9. Ingredients, allergens and dietary requirements

Bombshell Bakes uses ingredients that may contain or come into contact with common food allergens. Some recipes may be prepared without particular ingredients, including gluten-containing ingredients or animal-derived ingredients. However, our kitchen handles allergens, and we cannot guarantee that products will be completely free from allergen cross-contact. Customers must tell us about relevant allergies and dietary requirements before confirming a booking so that we can assess whether their requirements can be accommodated. We will provide appropriate allergen information for the products supplied. If we cannot confidently accommodate a particular requirement, we may decline that element of the order. Customers and event organisers should ensure that relevant allergen information is communicated to anyone being served the products.

10. Delivery and setup

Bombshell Bakes operates on a delivery-only basis. Customer collections are not offered. Delivery dates, locations and charges will be agreed as part of the quotation or booking. The delivery time or time window is agreed individually and normally confirmed during the week of the event. Where an exact time is essential, this must be agreed in advance. Orders must be received by the customer or an authorised person at the venue. We do not leave orders unattended. If no authorised recipient is available, we will contact the customer to agree next steps. Reasonable additional waiting or redelivery costs may apply where agreed and lawful. Where setup is required, it must be expressly included in the quotation; setup is not automatically included in a delivery charge. We do not provide or hire out display stands, platters, furniture, props or other event equipment. The customer or venue must arrange suitable access, parking or loading permissions, and a safe, level and sufficiently strong display surface, with any necessary tables and equipment ready at the agreed time. Please tell us in advance about stairs, restricted access, loading limitations and relevant venue rules. We may recommend a safer alternative or decline to install a cake or display in a position that we reasonably consider unsafe, including where the furniture, weather, temperature or access presents a significant risk. We will take reasonable care in transport and setup. If unforeseen circumstances threaten the agreed delivery time, we will contact the customer or venue as soon as reasonably possible and discuss practical arrangements. Any additional costs caused by undisclosed restrictions or changed arrangements will be discussed fairly; statutory rights are unaffected.

11. Handover and responsibility

We hand orders directly to the customer or an authorised venue representative. For installations, we complete the agreed setup before handover; we do not provide ongoing service, replenishment, supervision or clearance unless expressly agreed as part of the booking. We normally photograph completed installations and may photograph orders before a direct handover. Where practicable, our digital delivery record will note the delivery time, recipient, product condition and relevant instructions, and may request an electronic signature acknowledging receipt. A copy may be emailed to the customer. If a recipient cannot or does not sign, we may record the circumstances and other available evidence. An acknowledgement or signature confirms receipt and recorded handover details only. It does not amount to acceptance of hidden defects or a waiver of statutory rights. Following safe handover, the customer or authorised venue representative is responsible for subsequent storage, handling, display and service in accordance with the instructions provided. We are not responsible for subsequent damage caused by third parties, accidents, inappropriate movement, unsuitable display conditions or failure to follow care instructions. This does not exclude responsibility for any defect, damage, negligence or other failure attributable to Bombshell Bakes or restrict any statutory consumer rights.

12. Storage, display and serving

Cakes and desserts are perishable and may require product-specific storage and serving conditions. We will advise on refrigeration, handling and serving where appropriate to the commission. For products where suitable, we may recommend allowing approximately 30 minutes after removal from refrigeration before serving. This is not a general rule for all products: fresh cream, cheesecakes and other temperature-sensitive foods must be kept within their applicable safe storage and service conditions. The instructions supplied for the specific order take priority. Customers and venues must provide suitable refrigeration where required, follow care instructions and monitor display conditions. Cakes and desserts should be protected from direct sunlight, excessive heat, rain and other unsuitable conditions, particularly at outdoor events. Where non-edible supports or decorative elements are present, we will identify them as appropriate. They must be removed before affected portions are served or eaten. We are not responsible for deterioration arising after handover from failure to follow the instructions or from conditions outside our control, except where the issue is attributable to our own failure to meet our obligations.

13. Edible Flowers, Decorations and Non-Edible Elements

Bombshell Bakes uses only flowers suitable for culinary use in its edible floral decorations. Flowers are carefully selected and handled for their intended use. As with other ingredients, any relevant allergen or dietary information will be considered. Some bespoke creations may also contain non-edible structural supports or decorative elements. Where present, these will be identified as appropriate and must be removed before serving or consumption. Customers and venues should not add their own flowers or decorations without first checking that they are food-safe and suitable for contact with the finished product.

14. Venue and third-party arrangements

For weddings, corporate events and other venue-based commissions, customers are responsible for providing accurate venue details and communicating relevant venue restrictions, delivery requirements and setup arrangements in advance. The customer or venue must provide suitable tables and display surfaces, any required stands or platters, and adequate space and access ready for the agreed setup time. We arrange and present the commissioned food where setup is included; we do not supply event furniture or display equipment. Where delivery or setup requires coordination with a venue, event planner or other supplier, we may communicate with those parties as reasonably necessary to fulfil the commission. We will take reasonable care when working alongside other suppliers but are not responsible for their independent actions or omissions, except to the extent the law provides otherwise.

15. Photography and portfolio use

Bombshell Bakes may photograph its own finished cakes, desserts and displays for business records, portfolio, website, social media and marketing use. We generally photograph the creations rather than customers or guests. We may share photographs supplied by clients or professional photographers where appropriate permission and any relevant usage rights have been obtained. Identifiable people and private event information will not be published without an appropriate lawful basis or permission. If your commission involves a confidential event, unreleased product or other sensitive requirements, please tell us in advance so that suitable arrangements can be discussed.

16. Events beyond reasonable control

Occasionally, circumstances outside either party's reasonable control may affect an order, such as severe weather, major transport disruption, utility failure or other significant unforeseen events. We will contact you as soon as reasonably possible if such circumstances threaten delivery or performance. We will explore practical alternatives where available, including revised arrangements or rescheduling. If the commission cannot proceed, any refund or payment adjustment will be assessed fairly according to the circumstances, work completed, recoverable costs and applicable law. Nothing in this section removes your statutory rights or excuses a failure that we could reasonably have prevented.

17. Problems and complaints

If there is a problem with your order, please contact us as soon as reasonably possible with a description of the issue and, where available, photographs or other relevant information. If practical, please contact us before moving, altering or disposing of the affected product, so that we have an opportunity to assess the issue. We may consider the agreed specification, production and delivery records, photographs, handover information, storage and handling circumstances and any evidence supplied by the customer. A missing photograph, delayed report or unsigned handover record will not automatically invalidate a genuine complaint. We will assess each complaint fairly and explain our response. Depending on the circumstances and applicable consumer law, an appropriate remedy may include correction, replacement where feasible, a price reduction or a refund. We are not responsible for damage caused after safe handover by third-party interference or mishandling, but this does not affect liability for defects or failures attributable to Bombshell Bakes. Nothing in these Terms & Conditions limits your statutory consumer rights.

18. Liability and statutory rights

Bombshell Bakes will provide its products and services with reasonable care and skill and in accordance with the agreed description. Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or other rights that cannot legally be excluded. Customers retain all applicable statutory rights under UK consumer law.

19. Personal information

Personal information supplied during enquiries, bookings and delivery arrangements will be handled in accordance with our Privacy Policy.

20. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Nothing in this provision removes any mandatory consumer protections or legal rights relating to where proceedings may be brought.
